The lawyers at DZN successfully persuaded the Kentucky Court of Appeals to reverse and remand a trial court opinion denying the enforcement of an arbitration agreement. In an unanimous opinion issued today, the Court ruled that there was insufficient evidence in the record to conclude that the patient lacked capacity to enter into an arbitration agreement on admission to our client’s facility.
