Kentucky Legislature to Require Certificate of Merit in Claims against Healthcare Providers

On March 26, 2019, House Bill 429 was filed with the Kentucky Secretary of State’s office and will become a law in 90 days. This law will require any claimant filing an action against a defined healthcare provider or long-term-care provider to file a certificate of merit with the complaint. The certificate of merit must be an affidavit or a declaration that the claimant has consulted with at least one (1) qualified expert specific to the standard of care or negligence. This expert must have reasonable knowledge of the relevant issues in the case.  The full bill can be read here.
