Rebecca Schafer briefed, argued, and won dismissal of claims against a nursing home client based upon the one (1) statute of limitations in Lexington, Ky. Plaintiffs try to throw in the “kitchen sink” and argue that by filing a lawsuit damages during an entire residency are appropriate. At DZN, we work as a team to limit plaintiff’s claims to only what is compensable under Kentucky law. Great win for the defense!
